The property owner in this case dug up the backyard some time before code enforcement was involved. Once the neighboring property began to show serious signs of erosion problems, including a failing fence. The property owner filed a formal complaint after the responsible party failed to repair the problem.
This case was heard before the Municipal Court on August 16, 2007. The property owner was ordered to meet the city's requirements or the city would be ordered onto the property to correct the violation, repair the fence and bill the property owner for all costs.
